PRESENTATION AND INSPIRATION

All praises are reserved for Allâh-u Ta'âlâ, who brought us to the religion of Islam. May eternal blessings be upon our Prophet, Ehl-i Beyt and all his companions who taught us the legal issues related to our religion.

Let it be known that; The lexical meaning of the word fiqh means understanding.

In the term of religion (usage), the science of fiqh consists of knowing the decrees of Shari'ah and religious decrees, which are divided into two parts: fard-ı ayn and fard-ı kifâye.

The part of fiqh that is fard al-separate is to know the true beliefs (beliefs) first.

As for the decrees of the religion, it is to know the subjects that every taxpayer needs, such as the decrees of taqâra, prayer and fasting.

Likewise, it becomes obligatory for a person to learn the decrees about every worship required by Shari'ah. For example, it is fard for a person to know the issues related to zakat and the rules of pilgrimage to those who have a pilgrimage.

In addition, people who deal with trade and give their places to tenants should know which dealings are valid, which one is fâsid, and the provisions regarding genius interest.

Here is what is narrated from Enes (Radıyallâhu Anh): "Knowledge is fard for every Muslim man (and woman)" -Kabir, No: 10439, 10/195, Beyhakî, Shuabu> l-Iman, No: 1666, 1667,2 / 254) hadith-i sharif mentions this science, which is also called "Ilmihal".

Sindî (Rahimehullâh) narrates the comments about this hadith as follows: When they asked Abdullah ibni Mübârek (Radıyallâhu Anh) to explain this hadith:

He said, "The meaning of hadith is not like what the people think. The purpose is to explain that when a person has a problem about a religious issue, it is obligatory to investigate and learn the truth in order to solve it."
On the other hand, Sevrî (Rahimehullâh) said: "What is meant by this science are matters for which a servant is not excused if he does not know it."

The most adopted view among these explanations is that it means learning the five pillars of Islam from this obligatory science. Of course, since prayer and fasting concern everyone, regardless of whether they are rich or poor, it is obligatory for every Muslim to know the decrees about them.

In the fard of pilgrimage and zakah, since there are certain conditions such as being rich, being healthy and having road security, it is obligatory for those who have these conditions to learn the provisions regarding them.

In addition, it is obligatory for a person who wants to do business to learn about the issues related to shopping before starting that job, and so that the person to marry knows the matters related to marriage.

But there is also a regularity between obligatory duties. For, there is an obligation to be sincere in knowledge and deeds as well as knowledge before deeds, and it is fard to be between fear and hope after deeds. (Ali el-Kârî, Mirkâtü’l-mefâtîh, 1/477)

As for the part of fiqh, which is fard al-kifâya; that is the study of this science until one reaches the degree of giving fatwa, even the rank of ijtihad.

If a town abandoned learning fiqh in a deep sense, they would become sinners altogether.

However, if a person in every city accomplishes this duty and reaches the level of giving fatwa by studying science, then this fard is deducted from the others. In this case, everyone should imitate this person in the events that happen to them.

However, according to our proverb "Word flies, writing remains" and the poet's saying: "Every science that is not on paper is a waste, every secret that passes two people is also a good", all these questions that Fatih Hodja-e-fendi has answered for years, are written in this work in your hand. a permanent service has been offered to you.

However, since this work was prepared as a solution of Hocaefendi's speeches, the style you understand was preferred rather than literary sentences, and therefore, the language of speech was more dominant than the written language. Therefore, although some sentences in this work seem to be inverted according to the written language, since the purpose is to correctly understand the answer to the issue you are asking, this issue is ignored and the main purpose is to understand the addressee correctly.

On this occasion, I can promise to my readers that those who act with the fatwas in this work will not face any punishment in the related issues in the hereafter.

Since we are in a position of ignorance about fiqh issues, the cure of ignorance is only questioning and questioning, as stated in the hadith, then we should definitely ask every subject we suspect and act with the answer we receive so that we can be saved from the punishment of our Lord in the hereafter.

The effort to ask correctly and to achieve deeds is from us, and Tawfiq is from Allah Almighty. May my Lord help us to adapt our deeds to the sciences stated in this work. Amine!
